Please read these Terms of Service carefully before using Paysker. By accessing or using the platform you agree to be bound by these terms. If you do not agree, you must not use Paysker.
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Paysker LLC, a Delaware limited liability company ("Paysker", "we", "us", or "our"), governing your access to and use of the Paysker platform, website, and services (collectively, the "Service") available at https://paysker.com.
By creating an account, accessing, or using the Service in any way, you confirm that (a) you are at least 18 years of age, (b) you have read, understood, and agree to be bound by these Terms and our Privacy Policy, and (c) you have the legal capacity to enter into a binding contract in your jurisdiction.
You must be at least 18 years old to use Paysker. If you are under 18, you are not permitted to use the Service under any circumstances. We reserve the right to terminate any account we determine to be held by a person under 18.
2. Description of Service
Paysker is a paid messaging platform that enables users ("Askers") to send paid message requests to creators and professionals ("Creators"). Creators set their own price and reply window. Upon payment, the Creator receives the message and, if they reply within their stated window, the funds are released to them. If no reply is received within the window, the Asker is automatically refunded.
Important disclaimer: All content and responses provided by Creators on Paysker represent their personal opinions only. Nothing communicated through the Service constitutes professional legal, medical, financial, psychological, or any other regulated advice. Users engage with Creators entirely at their own risk and discretion. Paysker does not verify the qualifications, credentials, or expertise of any Creator and is not responsible for the accuracy, completeness, reliability, suitability, or usefulness of any Creator response.
Paysker acts solely as a technology platform facilitating communication and payment between users. We are not a party to any conversation between Askers and Creators and do not endorse any Creator or any view expressed through the Service.
3. User Accounts
To access most features of the Service you must register for an account. When registering you agree to:
- Be at least 18 years of age.
- Provide accurate, current, and complete information during registration and keep it updated at all times.
- Maintain the security and confidentiality of your account credentials. You are solely responsible for all activity that occurs under your account.
- Notify us immediately at [email protected] if you become aware of any unauthorised use of your account.
- Register only one account per person. Creating multiple accounts is prohibited.
- Not share your account with, or transfer it to, any other person.
Paysker reserves the right to suspend, restrict, or terminate your account at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion. We also reserve the right to reclaim or reassign usernames.
4. Payments and Fees
All payment processing on Paysker is handled by Stripe, Inc. Your use of payment features is subject to Stripe's terms of service. We do not store your payment card details.
Platform fee. Paysker charges a 20% platform fee on all Creator earnings. Creators receive 80% of the base message price. Fees are deducted automatically before funds are released.
Micro-fee. For messages priced under USD $10, an additional processing fee ("micro-fee") of 30% of the base amount is charged to the Asker on top of the message price. This fee covers elevated payment processing costs for small transactions.
Currency. All platform balances are denominated in United States Dollars (USD). Payouts to Creators are processed in USD. For Creators outside the United States, Stripe converts funds to local currency at the applicable exchange rate at the time of payout. Paysker is not responsible for currency fluctuations or bank conversion fees.
Minimum withdrawal. The minimum amount a Creator may withdraw to their bank account is USD $10.00.
Platform credits. Credits added to your Paysker wallet (including top-up balances) are denominated in USD, never expire, and are non-transferable. Credits have no cash value and cannot be redeemed for cash except via the withdrawal process described above (for Creators) or via refunds where applicable.
Refunds. If a Creator does not reply to a paid message within their stated reply window, an automatic full refund is issued to the Asker via the original payment method. All refunds are returned to the original payment method used for the transaction to prevent fraud and comply with payment network rules. Wallet-funded portions are returned to the Asker's wallet. Paysker does not issue refunds for messages that have been answered by a Creator.
Chargebacks and disputes. You agree not to initiate a chargeback or payment dispute with your card issuer for any valid, completed transaction on Paysker. Initiating a fraudulent chargeback may result in immediate account termination, recovery of the disputed amount plus any fees incurred, and referral to relevant authorities.
Taxes. You are solely responsible for determining and paying any applicable taxes on transactions you conduct through Paysker. Paysker does not provide tax advice.
5. Prohibited Uses
You agree not to use the Service for any purpose that is unlawful, harmful, or prohibited by these Terms. Without limiting the foregoing, you must not:
- Use the Service if you are under 18 years of age or are legally prohibited from using it in your jurisdiction.
- Submit, post, share, or solicit any adult, sexual, explicit, obscene, or pornographic content of any kind.
- Harass, abuse, bully, threaten, intimidate, or discriminate against any person based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or any other characteristic.
- Impersonate any person or entity, falsely claim an affiliation with any person or entity, or misrepresent your identity or qualifications.
- Send spam, bulk messages, automated messages, or use bots, scrapers, or other automated tools to interact with the Service.
- Engage in any illegal activity, including but not limited to fraud, money laundering, identity theft, or violating any applicable law or regulation.
- Solicit, request, or provide professional regulated advice — including legal, medical, financial, or psychological advice — through the Service. All Creator responses are personal opinions only and must not be presented or relied upon as professional advice.
- Infringe the intellectual property rights of Paysker or any third party, including reproducing, distributing, or creating derivative works from any content on the Service without authorisation.
- Attempt to circumvent platform fees, payment processing, or any other commercial terms of the Service.
- Initiate fraudulent chargebacks, payment disputes, or refund requests.
- Attempt to gain unauthorised access to any part of the Service, any other user's account, or any systems or networks connected to the Service.
- Transmit viruses, malware, or any other malicious code.
- Use the Service in a manner that could disable, overburden, damage, or impair the Service or interfere with any other party's use of the Service.
Violation of any of the above may result in immediate account suspension or termination, forfeiture of any pending balances where permitted by law, and civil or criminal legal action.
6. Creator Terms
The following additional terms apply to users who register as or become Creators on Paysker.
- Age requirement. You must be at least 18 years old to register as a Creator and to receive payouts.
- Identity verification. To withdraw earnings, Creators must complete identity verification through our Stripe-powered verification process. This is required for compliance with financial regulations and anti-money laundering laws. Government ID documents are processed directly by Stripe and are never stored by Paysker.
- Pricing and reply window. Creators set their own message price and reply window. Creators are responsible for ensuring these settings are accurate and reflect their current availability.
- Reply obligation. If a Creator accepts a paid message request, they must reply within their stated reply window. If no reply is made within the window, a full refund is automatically issued to the Asker and the Creator forfeits any payment for that message.
- Protected payments. Creator earnings are held safely until the Creator replies to the paid message. Funds are released to the Creator's Paysker wallet upon confirmed reply.
- Platform fee. Paysker deducts a 20% platform fee from all Creator earnings. Creators receive 80% of the base message price.
- Independent contractor. Creators are independent contractors and not employees, agents, partners, or representatives of Paysker LLC. Paysker does not direct, control, or supervise Creator responses. Creators are solely responsible for the content of their responses.
- Taxes. Creators are solely responsible for reporting and paying all applicable taxes on their earnings, including income tax, self-employment tax, VAT/GST, and any other tax obligations in their jurisdiction. Paysker does not withhold taxes on Creator earnings unless required by law.
- Personal opinions. All responses provided by Creators are personal opinions only. Creators must not represent their responses as professional legal, medical, financial, or other regulated advice, and Paysker expressly disclaims any such representation.
- Conduct. Creators are held to the same standards as all users under Section 5 (Prohibited Uses) and to the highest standards of honesty, respect, and professionalism in all interactions on the platform.
7. Intellectual Property
Paysker's intellectual property. The Service and all of its content, features, and functionality — including but not limited to the Paysker name and logo, software, text, graphics, user interface design, and code — are owned by Paysker LLC and are protected by United States and international copyright, trademark, patent, and other intellectual property laws. You may not copy, reproduce, modify, distribute, transmit, display, perform, publish, license, create derivative works from, transfer, or sell any content, information, software, or services obtained from the Service without our prior written consent.
Your content. You retain ownership of any content you submit, post, or transmit through the Service, including messages you send ("User Content"). By submitting User Content you grant Paysker a non-exclusive, worldwide, royalty-free, sublicensable licence to use, store, display, and transmit your User Content solely for the purpose of operating and providing the Service to you and other users.
Representations. You represent and warrant that (a) you own or have the necessary rights to submit your User Content, (b) your User Content does not infringe any third party's intellectual property rights, privacy rights, or any other rights, and (c) your User Content complies with these Terms and all applicable laws.
Scraping and data extraction. You may not use any automated means (including robots, spiders, scrapers, or crawlers) to access, collect, or copy any content or data from the Service. You may not frame or mirror any part of the Service without our prior written consent.
8. Disclaimers and Limitation of Liability
Disclaimer of warranties. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF DEALING. PAYSKER DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
No professional advice. All Creator content and responses available through the Service are personal opinions only. Paysker does not verify, endorse, or take responsibility for any response provided by a Creator. Nothing on the Service constitutes legal, medical, financial, psychological, or any other professional advice. You should always seek the advice of qualified professionals for matters requiring such expertise.
Limitation of liability. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PAYSKER LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Cap on liability. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PAYSKER'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO PAYSKER IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS (USD $100).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. To the extent such laws apply, some of the exclusions and limitations above may not apply to you.
9. Dispute Resolution
Governing law. These Terms and any dispute arising out of or relating to them shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Binding arbitration. PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS. Except for claims that qualify for small claims court (see below), you and Paysker agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service (including the formation, breach, termination, enforcement, interpretation, or validity thereof) shall be resolved exclusively by final, binding individual arbitration, rather than in court.
Arbitration shall be conducted under the American Arbitration Association (AAA) Consumer Arbitration Rules, which are available at www.adr.org. The arbitrator will apply Delaware law consistent with the Federal Arbitration Act. The arbitration will be conducted in Dover, Delaware or, at either party's request, via video conference. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class action waiver. YOU AND PAYSKER EACH WAIVE THE RIGHT TO PARTICIPATE IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ARBITRATION OR LAWSUIT. DISPUTES MUST BE BROUGHT INDIVIDUALLY, NOT AS PART OF ANY CLASS OR REPRESENTATIVE PROCEEDING. IF THIS CLASS ACTION WAIVER IS FOUND TO BE UNENFORCEABLE, THE ENTIRE ARBITRATION AGREEMENT IN THIS SECTION SHALL BE NULL AND VOID.
Small claims court exception. Notwithstanding the foregoing, either party may bring a qualifying individual claim in small claims court in Dover, Delaware, or in the small claims court of the county where you reside, provided the claim meets the court's jurisdictional requirements and is brought and maintained as an individual action only.
Informal resolution. Before initiating arbitration, you agree to contact us at [email protected] and give us a reasonable opportunity (at least 30 days) to resolve the dispute informally.
10. Account Termination
Termination by Paysker. Paysker may suspend, restrict, or permanently terminate your account at any time, with or without notice, for any violation of these Terms, for conduct that we determine in our sole discretion to be harmful to other users, Paysker, or third parties, or for any other reason. Upon termination, your right to use the Service will immediately cease.
Termination by you. You may request deletion of your account via the Settings section of the Service at any time, subject to the following conditions: (a) you have no pending unread messages awaiting Creator replies, (b) Creators have no active reply obligations on your account, and (c) you have no pending Creator payouts in progress.
Effect of termination. Upon account deletion:
- Your personal data will be anonymised or deleted in accordance with our Privacy Policy.
- Financial records, transaction data, and other information required for legal or regulatory compliance will be retained for the periods specified in our Privacy Policy (generally 7 years for financial records).
- Any remaining wallet balance will be forfeited unless you have completed Creator identity verification and are eligible to withdraw.
- Platform credits are non-refundable upon voluntary account deletion.
Provisions of these Terms that by their nature should survive termination — including Sections 7, 8, 9, and 10 — shall survive any expiration or termination of these Terms.
11. Changes to Terms
Paysker reserves the right to modify these Terms at any time. We will indicate the revised date at the top of this page. For material changes, we will provide notice via email to the address associated with your account or via a prominent in-app notification.
Your continued use of the Service after the effective date of any revised Terms constitutes your acceptance of the changes. If you do not agree with the revised Terms, you must stop using the Service and may delete your account.
